In continuation of the hearing in the case of blasphemy against a Kano based cleric Sheikh Abduljabbar Nasiru Kabara, a Federal High Court sitting in the state has today Wednesday 27 July 2022, repudiated to transfer a breach of fundamental rights suit filed by the cleric.
The cleric’s counsel, Dalhatu Shehu-Usman filed the application for the enforcement of fundamental human right in the case, having respondents as the Kano Upper Shari’a Court and Kano State Government.
The applicant in the suit was challenging the proceedings of the Upper Shari’a Court in the state, saying his client wants the suit to be transferred to another vacation court judge in the Nigeria’s capital Abuja.
Dalhatu Shehu-Usman told the court that client has lost confidence in the court believing that he will not have flaxen hearing, alleging that prior to the sitting today the presiding judge had a meeting with the Attorney-General of Kano state for over 30 minutes what his client deemed suspicious, but the presiding Judge, Justice Abdullahi Liman, refused to transfer the fundamental rights suit.
He then reasoned that ‘’ the visit of the Attorney-General of Kano State should not be associated with this suit’’ as suspected by the counsel to Sheikh Abduljabbar.
‘’ One party is not allowed to choose a particular court or judge his case should be tried”, Justice Liman adjourned the case to 22nd Sept, 2022.
Earlier the Counsel to the respondents, Dahuru Muhammad, clarified before the court that in the early hours of Wednesday counsel to the applicant served him with another copy of fundamental rights suit filed in Abuja, testifying to the court that filing of another breach of fundamental human rights suit while this is awaiting is an violation of court procedure.
The Kano State Government charged Kabara with four counts bordering on blasphemous comments against Prophet Muhammad (PBUH) on Aug.10, Oct. 25 and Dec. 20, 2019.
